Scotland has right to hold indyref2 without Westminster, experts argue
SCOTLAND does have the right to hold a referendum without the agreement of Westminster under a “people power” concept established at the time of the French Revolution, according to legal experts. Academics at Cambridge University have argued holding a de facto referendum or wildcat vote are both in theory valid pathways to independence as Scots have “constituent power”. But they have also warned either of these routes would be strewn with “political obstacles” and so reaching a “divorce agreement” with the UK Government is ultimately the only proper path to independence. Dr Raffael Fasel and Dr Shona Wilson Stark examined the issue of alternative routes to an independence referendum following the Supreme Court ruling that approval from Westminster is required.
The Supreme Court disagrees and in the end thats really all that matters.

The highest court in scotland is the court of session in Edinburgh .If foreign courts and organisations have the right to have a say over scotland , then of course we must take this to european and world organisation the uk is bound by , as we did when scots took the constant denial by westmisnter regarding "home rule" to the council of europe who ruled in scotland favour which prompted major , then blair to deal with the issue in the mid nineties onwards .

All peoples and nations across the world have a right to self determination as enshirned by internaional law at the united nations.
Every empire, controlling country or organisation in history has deemed it illegal for regions or nations to leave over the course of that history. It still happend though , with 62 nations alone leaving westmisnter rule .
Had that alleged illegality had any ground to stand on , there would be 200 odd countires self governeing in the world today , and we would still be stuck in the roman empire or some other ancient entity.
What news recently has alleviated your irritation and why?

It's over Thomas. Scotland had the vote and rejected your proposal.
The UK is not an empire. It is a democratic country with a shared history of four non sovereign states in union in one sovereign country.

Every empire, controlling country or organisation in history has deemed it illegal for regions or nations to leave over the course of that history. It still happend though , with 62 nations alone leaving westmisnter rule .
Had that alleged illegality had any ground to stand on , there would be 200 odd countires self governeing in the world today , and we would still be stuck in the roman empire or some other ancient entity.
What news recently has alleviated your irritation and why?
1. The supreme court says you can't. The UK Supreme court says no. 2. Nicola Sturgeon the separatist has been defeated by her own hand. How low down the chain do people have this fabled right to self determination Thomas? Birmingham? Yardley Gobion? Glasgow? Scotland is a part of the union. Had its referendum and your lot lost. Hoolyrood has the right to do whatever it can get away with. And if it decided that it wanted to hold indyref2 there is not much anyone else can do about it. But it looks as though little Nicky has read the runes and realised that come the referendum, the Nats will get their dials wiped. So she has jumped ship.
The Nats will now proclaim that everything is the fault of Westminster, the Labour party and everyone else, but the bottom line is that they have done a shit job of selling independence to the Scottish electorate.

It is a democratic country with a shared history of four non sovereign states in union in one sovereign country. The uk is a multi national state that is held together by the treaty of union 1707. When the three nation kingdom of england joined with the kingdom of scotland. Its a kingdom , not a country.
Under international law , either kingdom/nation/country has the right to withdraw from that treaty.
Only anti democrats like yourself cannot accept that.

Well scotland is one of the oldest countries in europe , with secure borders that have been intact for 800 years.
Interesting that the shetland is british argument ( in terms of partitioninng scotland as punishemnt of we leave the yookay) had died a death when the brit nats realise

Just heard the figures of a poll taken, (presumably in Scotland), 12 % of those asked said that they thought Sturgeon was a successful FM, 88% didn't think that.
Hmm.
She was successful in trashing independence, Ill give her that.

Out of £600,000 donated to the party for a ring fenced "independence" fund specifically put together to fight a referendum, the party has just £96k left and took a loan of £100,000 from Thickie Sturgeon's husband.
Is a Police investigation the real reason for her resignation ? And after all this turmoil for the SNP, the matter of whether Scotland will ever leave the UK is surely settled. It won't.
