But you are asking the wrong question. The problem with ECHR membership is not that we cannot stop asylum seekers but that we cannot remove them. If we were not in the ECHR that would not prevent a single person from seeking asylum - it would allow failed asylum seekers to be removed however. Yes, this appears to be the problem and where the law needs re-writing. How can it be that someone can destroy their documents and refuse to tell the authorities where they are from and still be here. What can we do. You can't deport someone if you don't know where to deport them to. Other countries wont accept them. So what? Prison? Holding camps? How long for? This is another myth. We can and do remove asylum seekers whether they have their documents or not. Finding the nationality of a displaced person is not that difficult unless they do not speak, have no fingerprints, have never been photographed ... We use interpreters, which will indicate a nationality and regional accents to pinpoint their region of origin, body language experts are also used, skilled interviewers can quite easily discover the veracity of a claimants story. International agreements with other countries can be used to 'investigate' where that is possible, economic migrants usually come from poor but relatively safe states. To say there is nothing we can do is lazy. Our government has cut funding and almost refuses to assess claim which is the core root of our problem.

The only workable system is offshore processing but the asylum industry and those on the Left are adamantly against anything that works - so we carry on as we are. The left advocates setting up asylum claim centres in France, that's where they board the boats but the Tories refuse to do it.

A right to a fair trial is enshrined in UK Law for anyone in the UK , no matter where they are from or their nationality here legally or illegally should they be suspected of breaking our Laws and has been for many years In relation to Slavery Laws in the UK the first Legislation in relation to Slavery was introduced in 1807 that banned all transportation of Slaves in the UK and right across the British Empire , a few years later another bill forbade the sale of slaves within the UK and our former Empire , fast forward to modern times those Laws were so antiquated and no longer fit for purpose and repealed taken off the law books in 1998 , today we have up to date legislation the Slavery Act of 2015. All our Laws are subject to change , additions too , parts no longer fit for purpose removed, the only Offence that I know of that has not been changed for a very very long time is " Murder " it is the shortage charge on the books it simply states " On such and such a date, at such and such place you did Murder so and so, Contrary to Common Law. When it come to overstayers in the UK when caught they have a choice either leave the UK voluntarily if you do you cannot return to the UK for three years, if they don't they can put before a Court, to decide if they should be deported or not, the same goes for bogus economic migrants and bogus asylum seekers, as far as I am aware

Wrong again that is what the Court of Appeal Court is for, to overturn wrongful convictions and or sentence if there is evidence that was not available at the time of the initial trial to support an appeal
