The other point is that it was a takeaway meal connected to working away from home or the normal office. Fair enough. According to the Durham Constabulary and Durham Police and Crime Commissioner, who attended Starmers beer & curry bash, such a gathering was perfectly acceptable and within the rules. However, had cake been on the table, well that's another matter entirely. Beer & curry, yes. Cake, absolutely not. A meal break while working away from home or the office seems (and was judged to be) reasonable.
The Police statement:
Following the emergence of significant new information, an investigation was launched by Durham Constabulary into a gathering at the Miners’ Hall, in Redhills, Durham on 30th April 2021. That investigation has now concluded.
A substantial amount of documentary and witness evidence was obtained which identified the 17 participants and their activities during that gathering. Following the application of the evidential Full Code Test, it has been concluded that there is no case to answer for a contravention of the regulations, due to the application of an exception, namely reasonably necessary work.

The first police investigation
"after reviewing the Durham video, "We do not believe an offence has been established in relation to the legislation and guidance in place at that time and will therefore take no further action in relation to this matter"
The second police investigation
"A substantial amount of documentary and witness evidence was obtained which identified the 17 participants and their activities during that gathering. Following the application of the evidential full code test, it has been concluded that there is no case to answer for a contravention of the regulations, due to the application of an exception, namely reasonably necessary work."
Both of these police findings / conclusions into "Beergate" were very different to the conclusions of the "Partygate" investigations.
But still some people cannot accept the conclusions of official police investigations
