Casual observer? Did you read your link in full...? Yes I did Did you? Forget the individual but not what the judge said Anybody involving themselves in this type of behaviour, this type of disorder, be an active participant or a curious observer can expect to be, save for the most exceptional circumstances, remanded into custody, and this defendant is remanded into custody.”

Riots are more serious and, in Parts of the UK, the likelihood of violence remains a serious possibility…

This is breaking the law. You have a human right to lawfully go about your business in any public place unless there is some sort of court injunction, which there wasn't. He should file a lawsuit.

If he's innocent he should appeal, and use legal aid to cover his appeal.

What you need to realise is that televisions are watching the responses of viewers and notifying the authorities if displays of support for criminal behaviour is observed. Think back about how you reacted to what you saw and get your excuses ready if you in any way expressed support for the rioters or criticised the police. Maybe the above hasn't been set up yet ... but one day the Chinese might provide our authorities with the wherewithal to do so?

I see some that were arrested say they were only watching hope they find a way to get justice yet bet they won't.
You always get some, plead guilty and 6 weeks argue and it might be 5 years, this happened to the actor Ricky Tomlinson.

So will journalists covering these events also be arrested as observers?

He sounds like a tyrant. If I were they, I would start to think along the lines that out of all those who attended the protests, there are going to be some who did not do anything illegal but were punished for their political persuasion. We have a right to a fair trial, as per no detention without trial unless it is a matter of security, i.e. danger to the public. We have a right to freedom of expression and the right to freely move around the country and be treated equally to all others. We can not be discriminated agaisnt by virtue of our political beliefs. The only time in this case where the police and courts actually have any jurisdiction is if it can be proved they were causing public disorder. That would be say like fighting the police, throwing something or setting fire to something. If they were standing there and shouting their political views then that is allowed and protected in law. The whole thing hinges on whether they intended to cause harm and at the same time did some action to this effect. Of course they could legitimately get them on conspiracy if they had not carried out the harm but had planned to by their actions of being equipped with say incendiary devices or knives.
With such an idiot as a judge there will likely be cases where the decision will be struck out by higher court judges. This will have the effect of creating case law to protect the "Far Right". This is how you turn a disaster into a success - lol - a bit of crowd funding I think.

So will journalists covering these events also be arrested as observers? Depends. Some social media activists — styling themselves citizen journalists — deliberately and belligerently insert themselves into and aggravate situations.
Bona fide journalists could also find themselves in trouble should they ignore police instructions at crime scenes and during violent protests...

So will journalists covering these events also be arrested as observers? Until relatively recently there was a law in Canada that made it a criminal offence for journalists to knowingly publish false information "calculated alarm the public" ... so they had to be careful how they reported police behaviour. Here in the UK in the 80s there was a story about how plain clothes policemen were inciting people to attack the police ... so giving them an excuse to act against the assembled demonstrators.
