Primacy of EU law What does the supremacy of EU law have to do with provisions of the German Criminal Code? This is surreal, Doc. There's no link whatsoever between the EU and a piece of German domestic criminal legislation prohibiting holocaust denial. Criminal law is the preserve of the member states. Simple point that went straight over your head - any German domestic Law must comply with EU Law. That you were unaware of this simple fact speaks volumes. |

The area of criminal justice covered by the anti-incitement provisions of the German Criminal Code (§ 130 StGB at your other link) is not currently a matter covered by EU Law. Besides which it is not an offence to believe the Holocaust is fake, as long as you don't express that belief publicly in Germany.

Whether its in a ceded area or not all domestic legislation must still comply with EU Humans Rights Legislation. So yes, the EU does not set the German Criminal Code, but that Code must be compliant with EU Law. The UK has struggled with this issue many times over the years. |
