Fury as rapist, 21, walks free as judge decides he is too young to be jailed A judge has allowed a man who raped a 13-year-old girl to walk free from court because he is too young to be jailed. Sean Hogg, 21, was found guilty of raping the teenager at Dalkeith Country Park in Midlothian, Scotland. But judge Lord Lake said Hogg being 17 at the time of the attack had to be taken into account when passing sentence. Hogg, from Hamilton, Lanarkshire, will only have to carry out 270 hours of unpaid work. ............Court papers reported by MailOnline state Hogg attacked the girl on a number of occasions in 2018. They also show in one assault he threatened the teenager and pulled down her clothing before seizing her by the wrists and forcing her to commit a sex act. I have no idea how 17 is to young. I suspect the Procurator Fiscal will have no truck but to appeal. From the photograph I see that this trial was held in the Sheriff court. This clearly should be a case for the High Court. |

The judge is insane and should be sectioned.
Retrial is the answer, and stick a hang em flog em type judge in there.

Retrial is the answer, and stick a hang em flog em type judge in there. ...the whole fucking country is insane...until they figure out what rights and remedies apply to what people and when then the whole bloody legal system should be scrapped and re-patriated to English courts. You can't have children running a country. |

It says he attacked her several times and looks like he is going back to the same area where the girl will be now aged about 17.
Boot camp in some desolate place might have been better for a number of years.
Hopefully the family have moved though doubt it.

Many fathers would approve of it if judges dishes out such derisory sentences. |

It still is. ..thanks noted...I was more inclined to comment on the pathetically lenient outcome of a high court ruling rather than what police may or may not get up to..but thanks for pointing that out... |

My aunt as a young girl gave evidence to the police that resulted in a teenage child killer being put away.
This was London and probably mid 40s. They lived above a corner shop that their Mum run.
About 4 years later the murderer walks in and goes up to her and says with a leer, 'I remember you'.
Her father goes to the police annoyed that they were not warned, does not like the outcome and they move from North to South London.

The Scots set their own laws , but it appears they do the same as what happens in England and Wales, as they crime was committed when he was a juvenile in law under the age of 18 year , but IMO he should have been sent to prison even if just a Youth Offenders prison

Please don’t tell SNP ScotGov or the Indy fanatics whatever you do because, no matter how sensible the measure, or how universal the issue, that just won’t do, no way! if they find out about this they will immediately take steps to remedy things because Scotland must be seen to be different and at odds with England on every issue possible, otherwise how will they be able to create grievances and drive that wedge between our 2 nations? They have already acted to create division by giving the vote to juveniles and, it appears, they are also determined to continue to allow juveniles to marry (and to be married off to much older and inappropriate partners) rather than follow England’s laudable example of raising the minimum age of marriage to 18. The fact that England did so to align itself with the UN’s initiative to stamp out child marriage across the globe matters not one bit - it appears that SNP ScotGov and the Indy fanatics would rather be at odds with common decency and shame the Scottish people on the international stage than be seen to be following England’s example on anything. |

There's a rabbit off somewhere with this report.
Isn't it the case that because he was over the age of 16 - at the time - of the offence and she was under 16 that sexual intercourse is legally classed as rape?
What was their relationship at the time, were they boyfriend and girlfriend?
Seems odd that he allegedly raped her several times over the course of a year.
