The court didn't attach any significance to it. The court concluded that the status of the road was immaterial. It's you and the others who have been stressing the significance of its status. If I have 'picked up on it', it was only to stress how absurd it was that others thought it a relevant factor in the case. Now, Squeaky, do you have a law degree? Law degree, is that something that masks commonsense and natural justice? The status of the footpath is important, it is not anything other than part of the higway originally reserved for pedestrians. However, local authorities wanting to grant planning permission, in pursuit of appealing to the green lobby and to counter objections from the public for creating too much vehicular traffic, have made some footpaths available to cylists, this has had some effect on people thinking bikes on footpaths are the norm. This way they can make wild claims that a low percentage of visitors to the new development will use the car. The LA is in cahoots with the developers to achieve the permission and do so by misrepresentation and even downright lies. |

So you haven't even read the judge's remarks have you The judge thought it might be a shared pathway. But that doesn't matter for the purposes of the offense. If you want to believe that its status is a defence to manslaughter, please continue to do so. Your argument proceeds on the assumption that only you are clever enough to understand what happened in the trial. You seem to think the judges' remarks flew over the heads of Grey's legal team.
